UGC Terms
User-Generated Content License Agreement By uploading or submitting any video, photo, image, audio, or other content (“Content”) to Gnaughty Gnomes LLC (“we,” “our,” or “us”), you agree to the following terms:
Ownership of Content
You remain the sole owner of all rights to your Content. Submitting your Content does not transfer ownership to Gnaughty Gnomes LLC.
License Grant
By submitting Content, you grant Gnaughty Gnomes LLC a worldwide, royalty-free, irrevocable, non-exclusive, transferable, and perpetual license to use, reproduce, edit, adapt, publish, distribute, display, perform, and create derivative works of the Content, in whole or in part, in any media now known or later developed. This includes, without limitation, use on our website, in online advertising, marketing campaigns, social media platforms, emails, and other promotional materials.
Consent and Releases
You confirm that:
- You are the creator or have the necessary rights to submit the Content.
- Any identifiable individuals appearing in the Content have given their permission for this use.
- Your Content does not infringe on the rights of any third party.
Compensation (Refund Offer)
If Gnaughty Gnomes LLC selects your Content for use in its marketing or promotional efforts (including, but not limited to, advertisements, social media posts, or website features), you will be eligible for a refund of the purchase price of the gnome featured in the Content. Refunds will be issued only once per product purchase, regardless of how many times the Content is used. No Other Compensation Other than the refund described in Section 4, you acknowledge that you will not receive compensation, payment, or consideration of any kind for granting this license or for our use of your Content.
Indemnity
You agree to indemnify and hold harmless Gnaughty Gnomes LLC from any claims, damages, or liabilities arising out of or related to the Content you submit.
Termination
Since this license is granted in perpetuity, it cannot be revoked once you submit Content. However, ownership of your Content remains yours.
